Terms of Service

By accessing and using ImageAssist.com.au ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Permission is granted to temporarily use the Service for personal or commercial real estate purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose other than real estate marketing
• Attempt to reverse engineer any software contained on the Service
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

ImageAssist operates on a credit-based system:

• Credits are purchased in advance and never expire
• Different enhancement types consume different amounts of credits
• Credits are non-refundable once purchased
• Credits are deducted upon successful completion of image enhancement
• Failed enhancements will not deduct credits from your account

Your uploaded images are subject to the following policies:

• All uploaded images are encrypted and stored securely
• Images are automatically deleted after 30 days
• You retain all rights to your uploaded images
• ImageAssist does not claim ownership of your images
• We do not use your images for training AI models without explicit consent

You are responsible for ensuring that:

• You have the right to upload and enhance the images you submit
• Your images do not violate any copyright, trademark, or other intellectual property rights
• Your images do not contain illegal, offensive, or inappropriate content
• You will not use the Service to process copyrighted images without authorization

By using Image Assist, you acknowledge that the photographer has granted permission for the uploaded images to be digitally altered and enhanced. You further confirm that your use of the platform for image enhancement purposes does not infringe upon any applicable copyright laws or the intellectual property rights of the original photographer.

While we strive to provide uninterrupted service, we do not guarantee:

• That the Service will be available at all times
• The accuracy or quality of AI-enhanced images will meet your specific requirements
• That the Service will be error-free or that defects will be corrected

In no event shall ImageAssist or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Service.

ImageAssist reserves the right to revise these terms of service at any time without notice. By using this Service, you agree to be bound by the current version of these terms of service.

These terms and conditions are governed by and construed in accordance with the laws of Australia, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
